As a result of several inquiries received regarding meetings and the expenditure of funds related to the FY2020 DRRSD Budget and Assessment Annual Town Meeting Article, the Town Clerk’s Office contacted the Office of Campaign and Political Finance (OCPF) to obtain legal guidance for all who are engaged in advocating a position related to this matter.

Deputy General Counsel for the OCPF, Sarah Hartry, offers the following guidance:

  • Since there is currently no ballot question, an individual or individuals can expend funds as they see fit.
  • However, should the school budget situation progress to a ballot question, groups advocating for or against the ballot question would be required to file as a Ballot Action Committee (BAC) through the Town Clerk’s Office.
  • As there is currently no Ballot question, filing as a BAC is not required at this time.
  • However, Attorney Hartry also stated, in an abundance of caution, it is recommended by OCPF, that groups should not advocate for or against a future ballot question, and should a ballot question be voted, all groups must file as a Ballot Action Committee through the Rehoboth Town Clerk's Office.
